These Terms and Conditions apply to the use of this website and govern the supply of goods and services sold by Garden Vista Group Ltd.  By accessing this website and/or placing an order you agree to be bound by these terms and conditions.

Introduction

You will be able to access most areas of this website without registering your details with us. Certain areas are only open to you if you register. We may change these terms and conditions at any time by updating this posting. You should check this website from time to time to review the terms and conditions to make sure you have the most recent version relevant to your contract.

Each order or purchase that you make is subject to these Terms and Conditions, including our Delivery Information, Privacy & Cookies Policy and Payment Security (where relevant) and any additional terms that apply regarding quotations, promotional offers and special offers.

Buying / Ordering Products

You are deemed to have placed an order with us by ordering online via our online checkout process, or by placing an order over the telephone. As part of the checkout process you will be given the opportunity to check your order and correct any errors. We will send you an order acknowledgement detailing the products you have ordered. This will be done by e-mail.

We will accept your order when we confirm the order by e-mail. We can send written confirmation of your order via Royal Mail, if requested.

In the event of an order placed by a company, that company is responsible for all orders placed by their authorized employees.

Once the order is accepted the contract is formed, however we may still refuse to accept your order after confirmation where:

  • Goods are not available. In which case we may offer the option of a substitution of similar type and quality. You will be notified of this substitution by post or e-mail or telephone before delivery to give the option to decline the substitution, in which case you will entitled to a full refund; or
  • We cannot obtain authorization for your payment; or
  • There has been a product description error; or
  • It is logistically impossible to deliver the goods to the specified location; or
  • Delivery surcharges are applicable and have not been paid; or
  • Through error, we have under-priced an item; we will not be liable to supply that item to you at the stated price. We will notify you of this before dispatching the item to you. In those circumstances, we will also notify you of the correct price, so that you may decide whether or not you wish to continue with the purchase. If you decide not to order the goods, we will give you a full refund on any amount paid in accordance with our Cancellations and Returns Policy set out below.

Once your order is placed we will send out an acknowledgement email, providing you with the applicable contact details as provided to us, your order reference number and estimated delivery date. You will be contacted prior to that estimated delivery date to notify you of the delivery day.

Prices & Payment Methods

Prices listed are in GBP and where stated are inclusive of delivery costs to selected UK postcodes and VAT, although additional charges may apply to deliveries in certain postcodes and remote parts of the United Kingdom or overseas. Please see each individual product for delivery information.

The latest prices are listed against each specific product on the website. Our prices are reviewed on a regular and frequent basis and any changes will be listed against each specific product on the site.

All prices must be paid in full before dispatch. Payment can be made by debit or credit card. We accept the following debit cards: Visa Debit, Maestro, Visa Electron & Solo

We accept the following credit cards: Visa and Mastercard.

When you make a payment by credit card, you are automatically covered by section 75 of the consumer credit act 1974. Section 75 is a piece of legislation designed to remove the risk that you, as a consumer, will ever get into debt paying for goods or services that you didn’t receive, were faulty or not as described. When you use your credit card to pay for goods or services between £100.00 and £30000.00, section 75 holds your credit card provider ‘jointly and severally’ responsible for your purchase. This means that you have the right to claim a refund from your credit card provider if there is a problem with the goods or services you ordered.

You may only pay for your order using a payment mechanism that you are authorized to use. All credit/debit card holders are subject to validation checks by any payment provider we employ. If the card issuer refuses to authorize payment or any other validation checks return adverse results, we will not accept your order and we will not be liable for any delay or non-delivery. We are not obliged to inform you of the reason for the refusal.

We are not responsible for the card issuer or bank charging the card holder as a result of our processing of the credit/debit card payment in accordance with the order. 

Payment Security 

Payment is taken when we receive your order. On-line and telephone order payments are processed via our SSL (Secure Socket Layer) secure payment system.

When you reach the point at which you need to provide sensitive information to us, a padlock icon will appear near the left side of the address bar of your browser. This acts as a certificate that signifies that you are entering a secure area. This mark is given only to duly acknowledged organizations that maintain good faith and high levels of protection. 

We use advanced encryption technology to protect your personal information using several layers of safeguards and firewalls. The padlock icon is visible again which means that the page you are browsing is secured. Clicking on the icon also provides details about our company which proves that we are registered and duly recognized to engage in online transactions. Please see our Online Payments page for more information. After finishing the payment, a message acknowledging the completion of the transaction together with a summary of the details will appear on your screen. A copy of the message will also be sent to your email.

Planning Permission and Building Regulations

It is important to remember that it is your responsibility to check whether your circumstances require planning permission or building regulations and that they can be subject to change over time.

At Garden Vista Group Ltd most of our buildings are designed to not require planning permission and would be able to be installed under Permitted Development Rules. However, there are exceptions. If you are unsure about planning regulations in your area, you should always check with your local Planning office who will be able to advise you on whether you will require planning permission for your garden building.

Installation & Building Base Terms & Requirements

Installation of timber buildings and some greenhouse will generally be carried out at the same time as delivery. Installation of most greenhouses will take place within two weeks of delivery.

If you are taking delivery of the greenhouse prior to installation, ensure that you have pre-checked your greenhouse contents straight away and report any missing parts.

Site Information

Please note that many components will not pass through the house or through a side gate with fixed head rail.  Please read the following statements:

Unloading: Can components be carried unhindered from lorry to base, i.e. no turns, restricted headroom, steps, fences or banks?

Access:  Can the delivery lorry get within 25 metres of the base?

If the answer is NO to either of these statements you need to make us aware so we can adjust the cost for the installation accordingly. Please contact us via email sales@gardenvista.co.uk or telephone 01730 893999.

If we cannot install the building on the delivery day for any of the above reasons, for which we have not be made aware, a revisit surcharge of 25% of the installation charge will apply, or extra costs to rectify the issue may be charged.

Installation Terms for All Buildings

It is the responsibility of the customer to ensure the following:

  • A level, flat and hardstanding floor area is prepared in readiness (we can arrange this for you within certain postcodes).
  • When preparing your floor area, please ensure you have checked the correct base dimensions.
  • If you are building a concrete floor, you may wish to consider allowing for drainage.
  • Ensure that the area where your building will be located is free from obstructions e.g. overhanging branches, power lines, manhole covers etc.
  • Ensure that the area where your building will be located has ample access to all sides. We recommend a minimum of 2ft clearance.
  • Ensure that you have checked whether planning permission may be required and that all building regulations are adhered to.
  • Additional installation has been purchased for the installation of any optional accessories such as staging and shelving.

Upon purchasing an installation service, you agree to the following:

  • If the installation is unable to be completed on the day of arrival due to the above terms not being adhered to, the full cost of the installation may still be warranted, with extra charges possibly occurring for a second installation attempt.
  • The disposal of greenhouse packaging is not the installers responsibility, and you should be prepared to dispose of any packaging, including that of any wooden pallet(s) and crate(s).
  • Installers may be that of a third-party installation company, unrelated to ourselves. You agree for us to pass on your information to the third-party in order for the installation to be arranged and carried out.

Additional Installation Terms for Halls Greenhouses

A base frame must be ordered along with the greenhouse (if it doesn’t already include one and isn’t provided with an integral base frame).

Delivery

UPDATE: March 2021 – If ordering a greenhouse please enquire regarding lead times. Due to Covid-19 some manufacturers are running on longer than normal lead times.

Any times or dates stated on our website or emails regarding delivery are estimates only. We endeavour to deliver all goods within 30 days, but this may be extended during busy times of the year, and we do not accept liability whatsoever for any failure to deliver within that time and offer no compensation for failure to deliver within any given timescale.

For offshore or remote mainland deliveries please contact 01730 893999 for specialist advice.  Please note we may be unable to deliver some of our products to certain postcodes.

Our delivery service is kerb side only. If access for delivery is restricted please ensure that you inform us when placing your order or in all circumstances prior to dispatch of the goods. Failure to do so will result in the delivery being treated as a failed delivery if access is unavailable and may result in a re-delivery charge being applied.

Garden Vista Group Ltd will not be held responsible for loss of earnings due to failed or delayed delivery.

Due to the nature of external contract delivery, additional delivery charges are outside our control and the Garden Vista Group Ltd will not be held responsible for such costs. If you have placed your order online and an additional delivery surcharge is required your order will be placed on hold and you will be contacted to notify you of any additional charges. You can then choose to continue with your order by paying the additional delivery charges or you may cancel your order at that point.

There must be someone available on the delivery day to sign for and accept the delivery, otherwise a redelivery charge will apply.

During adverse weather conditions our delivery service may be affected in some areas, resulting in lead times being slightly longer than advertised. Every effort will be made to maintain service levels on behalf of our customers and where safe to do so, and depending on the local prevailing conditions, collections and deliveries will be attempted.

Incorrect personal details may also lead to problems or delays in delivery, so before placing your order, please ensure that you have included the full delivery address details, including an accurate postcode of the delivery address and your daytime contact telephone number(s) and an up-to-date email address so that we can notify you in the event of a delivery problem.

Missed or Refused Delivery

If a delivery is missed or refused at the delivery address, and re-requested for another date, we may charge for the second delivery. If you refuse to accept an item that is being delivered for any reason you must notify us immediately with the reason for refusal to sales@gardenvista.co.uk.

Upon Delivery

For large log cabin deliveries we deliver the goods on a large lorry with a moffat forklift unloader due to their size and weight, so will need an access road capable of taking a vehicle 16.5m long, 2.7m wide and 5m high. If we have to deliver using different vehicles or if we cannot safely bring a vehicle to your site then any further costs incurred by us in arranging the delivery will be applied to your order.

Delivery will be deemed as successfully made once the product has arrived at the address specified and been signed for (by an adult aged 18 years or more), or you have taken delivery in person without signing for the delivery or a delivery note has been left. The driver will not request assistance unless it is offered by the customer.

We operate a one man kerb side delivery, and delivery drivers may take photographs of the delivery and the delivery point. Any photographs taken are only used for internal purposes such as training and delivery service improvement.

Products are your responsibility once they have been received by you, your agent or the intended recipient or a signed note has been left indicating that delivery can be left unattended. Any loss or damage to the products will be at your own risk.

We advise that you do not arrange any third party ancillary services (e.g. installation) until all goods are delivered and checked. We will not be held responsible for unnecessary expense incurred in this regard where the delivery date has been relied upon but not met. Compensation will not be issued under such circumstances.

In case of delivery to certain locations such as hospitals, airports, hotels, ships and other business premises, the signature of any person authorised to accept delivery on behalf of that organisation shall be accepted as proof of delivery of the goods to yourself.

If there is cause for concern or any other problems identified, such as damaged parts, on or after delivery, do not attempt assembly. Please telephone us on 01730 893999 for further advice.

Cancellations & Returns Policy

Garden Vista Group Ltd always strives to offer an excellent customer service both online and in-store. We want to make it as easy as possible for you to cancel/return orders or report faulty/missing products.

We’re confident you’ll have a happy experience when you buy from us, but if you’re not 100% happy with your new purchase, you can return it within 14 days of delivery – as long as you haven’t used it already and it’s in its original delivered state with original packaging. If you have ordered a building with installation you would need to cancel your order before the building has been installed and a cancelled installation charge may apply.

How to cancel your order before delivery

If you wish to cancel your order before the goods have been dispatched you should e-mail us at sales@gardenvista.co.uk with the words ORDER CANCELLATION in the subject line, or by recorded post to Garden Vista Group Ltd, Haslemere Garden Centre, Haslemere Road, Brook, Godalming, GU8 5LB.

You will receive a full refund of the total cost of your order, including delivery, withing 14 days of cancelling your order.

Right to cancel and return your order once received

Under the Consumer Contracts Regulations (which has now replaced the Distance Selling Regulations), you have the right to cancel your order within 14 days of having received the goods without giving any reason.*

To exercise the right to cancel, you must clearly inform us of your decision to cancel the contract via email at sales@gardenvista.co.uk or by recorded post to Garden Vista Group Ltd, Haslemere Garden Centre, Haslemere Road, Brook, Godalming, GU8 5LB.

To meet the cancellation deadline, you must send your communication concerning your exercise of the right to cancel before the 14 day cancellation period has expired.

*Excluded are bespoke products, special orders, perishable products, buildings once installed or buildings purchased through our Show Site, unless they are faulty or damaged.

Effects of returning your order

If you choose to exercise your right to cancel, we will reimburse to you all payments received from you, including basic delivery charges (but excluding postcode related delivery supplements and less any collection/return charges, e.g. repackaging and administration charges).

You will however have to bear the direct cost of returning the goods. This may involve either posting the item yourself or paying a collection charge.

Products must be returned with proof of purchase and complete with all components including instruction booklets etc.

If you have opened the packaging and the value of the goods has been reduced as a result of you handling them more than was reasonably necessary (more than if you were assessing them in a shop) Garden Vista Group Ltd reserves the right to make a reasonable deduction to the refund price in accordance with the condition of the goods and to cover repackaging/administration fees. Any reduction is at the absolute discretion of Garden Vista Group Ltd who reserve the right to make no refund at all if the product is not in a condition to be re-sold.

We will refund you within 14 days of either us/building manufacturer receiving the returned goods back and after inspecting them. For orders delivered by external suppliers, generally we will not issue your refund until we have received written correspondence from said supplier detailing either cancellation or collection confirmation and associated costs.

Reimbursement will be made using the same means of payment used for the initial transaction, unless expressly agreed otherwise.

Faulty & missing products

If upon receipt you discover a product to be damaged, please notify us by sending a photo and description to sales@gardenvista.co.uk without undue delay. If an item is missing, please locate its product name in the assembly instructions and notify us via the above email. We will endeavour to resolve any issues as soon as possible by replacing or supplying any damaged or missing goods free of charge.  A refund and collection will only be offered under exceptional circumstances and must be authorized by us in writing.

Events beyond our control

We shall have no liability to you for any failure or delay in supply or delivery, nor if performance of any of our obligations is prevented or restricted, nor for any damage or defect to products supplied or delivered under our agreement, in each case that is caused by any event or circumstance beyond our reasonable control (including, without limitation, the following to the extent these are outside our reasonable control: accidents, extreme weather conditions, fire, explosion, flood storm, earthquake, natural disaster, failure of telecommunications networks, inability to use transport networks, acts of God, terrorist attack, war, civil commotion, riots, strikes, lockouts and other industrial disputes, acts or restraints of Government, and imposition of restrictions on imports or exports).

Liability

These Terms and Conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the English Courts.

These Terms and Conditions, together with the privacy policy, security policy, any order, order acknowledgement and communications and payment method instructions, if any, are the whole agreement between you and us. If any provision or terms of these Terms and Conditions is found by any competent jurisdiction to be invalid, the invalidity of that provision will not affect the validity of the remaining provisions which shall continue to have full force and effect.

Only the parties to these terms and conditions may seek to enforce them under the Contracts (Rights of Third Parties) Act 1999.

You must be over 18 years to purchase products and register with this website.

Nothing in these terms and conditions shall exclude or limit our liability for (i) death or personal injury caused by negligence (as such terms is defined by the Unfair Contract Terms Act 1977); (ii) fraud; (iii) misrepresentation as to a fundamental matter; or (iv) any liability which cannot be excluded or limited under applicable law.

We have used our best endeavours to ensure that our website complies with UK laws. However, we make no representations that the materials on our website are appropriate or available for use in locations outside the UK. Those who visit our website from other locations do so on their own initiative and are responsible for compliance with all applicable laws.

You agree to indemnify us fully, defend and hold us, and our officers, directors, employees and agents, harmless from and against all claims, liability, damages, losses, costs (including reasonable legal fees) arising out of any breach of the terms and conditions by you, or your use of this website, or the use by any other person using your registration details.

We will not be responsible to you, your business, or if you are undertaking work for another person, to any other person, for the use or installation of any products by you (or on your behalf). Accordingly, you hereby agree to hold us harmless and indemnify us against any liability associated with any claim or allegation that we are responsible for any failings in the installation or use of any products that we supply. This would also include damage to your property or possessions through the use or misuse of the product.

If you are acting as a business customer in your ordering/purchasing of products, you acknowledge and agree that all our obligations to you are set out in our agreement.

These terms and conditions do not affect your statutory rights.

Modifications to Our Website

While we endeavour to ensure that the information on this website is correct we do not warrant the accuracy and completeness of the material on this website. We may make changes to the material on this website or to the products and prices described in it.

If you are relying wholly on any content to make your purchase decision please feel free to contact us on 01730 893999 to clarify and confirm any detail prior to placing your order with us. This does not affect your statutory rights.

Photographs & Images

Photographs and images on our website may have been supplied to us by the manufacturers, or with regard to our own products they will have been supplied by us, but in any event they are used to represent the style of the product only. Timber products in particular are natural products and as such are liable to colour variations.

Visitor material & Conduct

Other than personally identifiable information, which is covered under the Privacy Policy, any material you transmit or post to this website will be considered non-confidential and non-proprietary.

You are prohibited from posting or transmitting to or from this website any material:

  • that is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience;
  • for which you have not obtained all necessary licences and/or approvals;

Service Access

While we endeavour to ensure that this website is normally available 24 hours a day, we will not be liable if for any reason it is unavailable at any time or for any period.

Access to this website may be suspended temporarily and without notice in the case of system failure, maintenance or repair, or for reasons beyond our control.

Registration

Each registration is for a single user only. We do not advise you to share your user name and password with any person, nor with multiple users on a network.

Garden Vista Group Ltd try to ensure that all information on this site is accurate. However, if an error does occur we will contact you as soon as we become aware of the error, to discuss whether you wish to continue with your order or not. If you cancel your order you will receive a full refund of any charges paid in advance.

Vouchers / Promotions

Vouchers can only be used online at www.gardenvista.co.uk subject to these terms and conditions and any other specific conditions notified to you on the issue of a voucher. Your use of a voucher indicates your agreement to be bound by these voucher terms and conditions.

We reserve the right to withdraw, vary or cancel a voucher for any reason at any time. Vouchers may be limited to redemption in respect of certain products or services or certain products or services may be excluded from the ambit of use of the voucher, in which case notice will be given to you at the time of issue of the voucher.

Vouchers are, and remain at all times, the property of Garden Vista Group Ltd. The right to use a voucher is personal to the original recipient and may not be transferred. No voucher may be copied, reproduced, distributed, or published directly or indirectly in any form or by any means for use by an entity other than the original recipient, or stored in a data retrieval system, without the prior written permission of Garden Vista Group Ltd.

Vouchers distributed or circulated without the written approval of Garden Vista Group Ltd, for example on an Internet message board or on a “bargains” website, are not valid for use and may be refused or cancelled. Unless expressly stated otherwise at the time of issue of the voucher, each issued voucher will be valid for use by a recipient only once.

A voucher may not be used in conjunction with any other special offer or voucher. Vouchers cannot be exchanged for cash. Where an online offer states that a percentage discount will be given on a purchase, the cost of the qualifying purchases will be reduced by the stated discount percentage. Supplementary charges such as delivery charges shall not be discounted, unless specifically stated in the offer description. When you use a voucher you warrant to Garden Vista Group Ltd that you are the duly authorized recipient of the voucher and that you are using it in good faith. If you redeem, attempt to redeem or encourage the redemption of vouchers to obtain discounts to which you or a third party are not entitled you may be committing a civil or criminal offence.

If we reasonably believe that any voucher is being used unlawfully or illegally we may reject or cancel that voucher and you agree that you will have no claim against us in respect of any rejection or cancellation. If we refuse a voucher submitted as part of an order, for any reason, we will inform you before the order is dispatched to advise of the correct cost of the order and give you the opportunity to cancel the order.

The failure of Garden Vista Group Ltd to take any action in respect of a breach of these Terms and Conditions shall not constitute a waiver of their enforceability. Garden Vista Group Ltd reserves its rights in respect of these terms and conditions at all times. A voucher is redeemed by entering its code at the appropriate point in the online purchase process. Redemption may be subject to you providing proof of entitlement to use the voucher.
